Acceptance of Terms

By accessing or using RiseGen Leads ("RiseGen," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree with these Terms, you may not access or use our platform or services.

Eligibility

RiseGen services are intended solely for licensed insurance professionals, agencies, and businesses purchasing consumer leads for lawful business purposes. You are responsible for complying with all applicable federal, state, and local laws governing your use of purchased leads.

Accounts

You are responsible for maintaining accurate account information and for all activity occurring under your account. You are responsible for safeguarding your login credentials and immediately notifying us of any unauthorized use.

Orders & Billing

Orders begin processing immediately after successful payment unless otherwise specified. Prices, inventory, and availability are subject to change without notice.

By placing an order you authorize RiseGen to immediately begin fulfilling your purchase.

Lead Delivery

Leads may be delivered through the RiseGen dashboard, CRM integrations, email, SMS notifications, downloadable PDFs, API connections, or any other delivery method supported by RiseGen.

Delivery estimates are not guarantees and may vary depending on inventory availability, geographic targeting, holidays, carrier limitations, advertising platform performance, consumer demand, or other operational factors outside of RiseGen's control.

Lead Ownership

Ownership of purchased leads transfers to the customer immediately upon successful delivery to the RiseGen dashboard, CRM integration, email, SMS notification, downloadable PDF, API integration, or any other supported delivery method.

Once delivered, a lead is considered accepted, fulfilled, and delivered. Delivered leads cannot be returned, revoked, cancelled, or exchanged.

Lead Quality Disclaimer

RiseGen uses commercially reasonable efforts to provide accurate, exclusive, and high-quality consumer leads. However, consumer information may change after submission and RiseGen does not warrant that every lead will answer the phone, remain interested, qualify for coverage, or ultimately purchase insurance.

No Guarantee of Results

RiseGen provides consumer marketing data and lead generation services only.

RiseGen does not guarantee appointments, quotes, policy sales, commissions, income, return on investment, profitability, conversion rates, contact rates, or any specific business outcome.

Sales success depends on numerous factors outside of RiseGen's control, including response time, follow-up, licensing, pricing, underwriting, competition, sales ability, and consumer circumstances.

Replacement Policy

Customers may request replacement leads in accordance with the RiseGen Replacement Policy.

Approved replacements are issued solely at RiseGen's discretion. Customers must provide the applicable Order ID together with any requested supporting documentation.

Approval of one replacement request does not create an obligation for RiseGen to approve future replacement requests.

No Refund Policy

All sales are final.

Due to the digital nature of consumer lead data and the immediate transfer of ownership upon delivery, RiseGen does not provide refunds for completed purchases, partially delivered orders, or delivered leads.

Customers acknowledge that delivered leads cannot be returned, cancelled, revoked, or exchanged. Approved replacement leads are the exclusive remedy for qualifying lead issues.

By placing an order, customers expressly waive any claim for a refund based on lead performance, sales results, commissions, appointment rates, conversion rates, contact rates, or any other business outcome.

Chargebacks & Payment Disputes

Customers agree to contact RiseGen before initiating any payment dispute or chargeback.

Fraudulent or improper chargebacks for successfully delivered digital products may result in account suspension, termination, denial of future purchases, collections activity, recovery of reasonable attorneys' fees where permitted by law, and submission of delivery records demonstrating fulfillment.

Acceptable Use

Customers agree not to misuse the platform, attempt unauthorized access, interfere with platform operation, resell leads in violation of applicable law, or use purchased data for unlawful purposes.

Intellectual Property

All software, branding, designs, trademarks, logos, content, documentation, and technology provided by RiseGen remain the exclusive property of RiseGen, LLC unless otherwise stated.

Limitation of Liability

To the fullest extent permitted by law, RiseGen, LLC, its owners, employees, contractors, affiliates, licensors, vendors, and partners shall not be liable for any indirect, incidental, consequential, punitive, exemplary, or special damages arising out of or relating to your use of the platform or any leads purchased through the platform.

RiseGen's total aggregate liability for any claim shall never exceed the amount actually paid for the specific order giving rise to the claim.

Governing Law

These Terms shall be governed by and construed under the laws of the State of Ohio, without regard to conflict of law principles.

Changes to These Terms

RiseGen reserves the right to modify these Terms at any time. Updated Terms become effective immediately upon posting. Continued use of the platform constitutes acceptance of the revised Terms.
